Taxpayer funding to cover pregnancy termination in breach of the Hyde amendment.
The Department of Health and Human Services is facilitating access to abortion for migrant youth. In a memo from HHS to the Office of Refugee Resettlement (OCR), guidelines have been provided for abortion services including instructions to “make all reasonable efforts” to assist migrant minors with access to abortion if they request it, including transportation to a state in which the procedure is lawful and available.
The guidance focuses on providing shelters for pregnant minors in states where abortion access is available. If the pregnant migrant minor is sheltered in a state where abortion is illegal, and she requests an abortion, transportation must be provided to another state where the procedure is not banned.
In the U.S., there is a legislative provision known as the Hyde Amendment that prohibits the use of federal funds to pay for abortion, except to save the life of the woman, or if the pregnancy occurs as a result of incest or rape.
